Employees Have the Right To:
- Decide for themselves whether to support or oppose union representation
- Ask questions and seek information
- Discuss union-related topics
- Vote by secret ballot without pressure or retaliation
Employees also have the right not to participate in union-related activities if they choose.
Your Information
Is it true that my personal information must be provided to the union? Why are you providing this information? Can I object to my information being sent?
Axalta was required by law to submit to the UAW and the NLRB an alphabetized list of all employees who are eligible to vote in the upcoming election by Monday, March 23rd, 2026. The voter list included the full names, work locations, shifts, job classifications, and contact information (including home addresses, available personal email addresses, and available home and personal cell telephone numbers) of all eligible voters.
Normally, we would never give out this personal information, which we regard as confidential. We do so only to comply with the law. Unfortunately, you cannot object to this information being sent to the union. We regret any inconvenience or annoyance that any invasion of your privacy by the union may cause.
What will the union do with this information?
The union usually utilizes your personal information in a few ways:
- Mass mail union material to your home
- To visit you at home or on your cell phone like a telemarketer
- To text or email you information that you never requested
- The union will do or say just about anything to try to convince you that their union is the answer to all your problems.
The union may call you and mail information to your house, email you, and have co-workers try to talk to you about the benefits of the union, if they haven’t been doing this already.
The union organizers may share a couple of their very best contracts, and some unions may even present fake contracts with false increases in salaries and benefits. Some unions pick and choose only the very best clauses in a number of contracts and share these to make it look like they can provide a great service to you. This is done to try to mislead you into believing that your wages, benefits, and terms and conditions of employment can only go up in contract negotiations, which is not always the case and cannot be guaranteed in advance because negotiations are always a give-and-take process.
What can I do about the UAW contacting me?
You are not required by law to talk to the union’s representatives, nor are you required by law to respond to any information they are sending. You have the right to treat them the same as any other salesperson. You can ask them to leave you alone. If they do not, you can treat it like you would any other unwelcome person trying to contact you.
Again, we regret any inconvenience or annoyance that any invasion of your privacy by the union may cause. It is unfortunate that they may do this once they have your personal information. However, it is part of the process and should only be for a short period of time.
Media Requests
What should I do if I'm approached by media?
The decision to support or oppose a union is entirely yours, and you are free to hold and express your personal views. If speaking publicly, it must be clear you are speaking only for yourself, not for Axalta. Employees are not disciplined for supporting or opposing a union; issues only arise if someone claims to represent Axalta, shares confidential information, or implies their personal view is the company’s position.
